Terms of Service
Thank you for choosing Studio LHK, LLC. We are excited to work with you!
This agreement is between “Client” and Studio LHK, LLC (“Designer”) and it will be effective upon the date of the Client’s package purchase and will remain in effect until all services are fully completed.
SERVICES
Studio LHK, LLC., provides online interior design services and may include the following:
-Developing interior design plans (floor plans, mood boards, renderings, sketches, notes, finish/furniture specifications)
-Selecting interior items and furnishings (furniture, lighting, fabrics/textiles, upholstery, flooring, appliances, accessories, artwork, plants)
-Providing a product list of the interior items and furnishings for you to order and purchase.
We do NOT provide the following services:
-Interior products and furnishings procurement and installation
-Custom cabinetry
-Custom window treatment
PROJECT SCHEDULE
The project schedule will be outlined and agreed upon during the kick-off email before the design phase. Client timelines are set on a project basis, which may result in a more extended time for projects to be started or completed depending on the Designer’s workload and availability.
Typically a single-room project is ready for the Client to shop for their design plan in 3-4 weeks.
Project timelines depend on the Client’s prompt communication and Designer availability.
*If you want to secure your package and are not ready for the Designer to start designing, please note your desired time frame in the design questionnaire.
PAYMENT
All payments for the design services are due at the time of checkout. The Client will be responsible for any fees associated with payment returns.
Invoice payments are due 7 days after receipt. If the invoice is not paid in full within 7 days, the Designer shall have the right to immediately terminate this agreement with no further obligation, retain any money already paid as liquidated damages, and is not required to complete the project. The invoice must be paid in full to start the job.
REFUND
All design service package purchases and paid invoices are considered final sales and will not be refunded or creditable for any reason.
APPROVALS & REVISIONS
We offer revision opportunities with all of our design packages:
-Lite: 2 revisions
-Standard: 2 revisions
-Premium: 3 revisions
We request that you return all approvals and revisions within 48 hours.
INFORMATION
Please ensure that all information provided to us is accurate, especially the measurements. We will not be responsible for any errors or omissions due to incorrect information provided.
BUSINESS HOURS
Studio LHK, LLC’s business hours are Monday-Friday, 9:00 am - 4:00 pm CST. Please contact us via email (hello[at]studiolhk.com) or fill out the contact form on the website. Please allow at least 48 hours for our response.
COMMUNICATIONS
Our primary communication will be via our online design portal or email. Designer will typically respond to messages within 48 hours. Client understands that any delay in communication may result in an extension of service completion or the unavailability of products. Designer is not responsible for any issues due to late communication.
Client understands and agrees that it is their responsibility to respond to Designer within 72 hours to ensure there is no lapse in communication.
If Designer does not receive a response from Client within 72 hours, Designer will notify Client one additional time requesting a response. If there is no response within 24 hours after the final request, Designer may terminate this agreement, and retain all payments made as liquidated damages.
INTELLECTUAL PROPERTY
Studio LHK, LLC., retains all intellectual property and proprietary rights to all design plans and product lists, whether preliminary or final designs. The client is given a limited right to use the designs for personal home decorating purposes and shall not sell or use them for commercial purposes. You and third parties involved in the project are permitted to share images, photos, and videos of the finished design space on social media with appropriate credit to us. Please tag our social media accounts for all social media posts of the finished design space.
We may share our client designs on social media and our website. Please let us know in writing if you want to keep your designs private from social media and our website.
THIRD-PARTY VENDOR RELEASE OF LIABILITY
Studio LHK, LLC is not responsible and shall not be held liable for the following:
(a)methods or procedures of construction, fabrication, delivery, installation, or safety precautions of a third-party vendor; (b)any refund, property damage, personal injury, loss, delay, or replacement caused by any acts or omissions of a third-party vendor, contractor, subcontractor, or other person installing the work on online interior design project; (c)any failure to meet any schedule or completion dates by a third-party vendor.
DESIGN PLANS
Designer’s drawings are not to be used for architectural or engineering purposes. Our work scope does not include modifications to structural, HVAC, plumbing, electrical or other mechanical systems. Designer is not responsible for any issues related to the architectural or engineering of the space. Client understands and agrees that Client is responsible for hiring appropriate professionals for such services.
PRODUCT RECOMMENDATIONS
Client understands the nature of online shopping and interior design services that Designer has not and cannot see every item we recommend in-person. Designer will use design expertise with reviews to confirm high-quality items that will fit within your design. However, Designer cannot guarantee that the color, detail, material, or finish in the vendor’s online description will be accurate. Additionally, while Designer will ensure that all product links are current and available at the time of design presentation, there is no guarantee that the product will be available for purchase within a specific time frame due to the nature of online shopping.
PRODUCT/FURNISHINGS EXPENSES & PROCUREMENT
Our service does not include product/furnishing procurement. Client is responsible for ordering, payment, returns, and exchanges of all products you order. You understand that availability and prices of products/furnishings on the product list are subject to change before an order is placed and may not reflect the final costs due to additional fees (sales tax, shipping, delivery fees, etc.), which are often not known until the order is placed. You understand that you are responsible for all such additional costs and reviewing all product refund/exchange policies before purchasing, and know that some products may not be refundable or replaceable. Studio LHK, LLC is not responsible for any costs/issues associated with returns and/or cancellations of items.
Studio LHK, LLC offers a 14-day link guarantee policy. If any of the products on the final product list becomes unavailable within 14 days after the final presentation, the Designer will source the replacement without additional fees. After this period, we charge $40 per item that needs replacement.
FORCE MAJEURE
Neither party will be liable for any failure or delay in performing an obligation under this agreement that is due to any of the following causes (which causes are referred to as “Force Majeure”), to the extent beyond its reasonable control: (a)acts of God; (b)natural disaster (fires, flood, explosions, earthquakes, hurricanes, storm), epidemic, pandemic; (c)war, invasion, terrorist acts, riots, civil commotion; (d)breakdown of web host, breakdown of an internet service provider; (e)governmental acts or omissions, changes in laws or regulations; (f)breakdown of communication and/or transportation facilities; (g) national strikes (h) generalized lack of availability of raw materials or energy.
For the avoidance of doubt, Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit or avoid a financial loss, (b) changes in market prices or conditions, or (c) a party’s financial inability to perform its obligations hereunder.
The impacted party shall notify the other party within 10 days of the Force Majeure event, stating how long the occurrence is expected to continue. The impacted party should try to end the failure or delay caused by the Force Majeure event. If the impacted party’s failure or delay remains uncured for 14 days following the notice given by it, the other party may after that terminate this agreement upon notice. All payments made by Client to Designer up to the date of the Notice of a Force Majeure Event are non-refundable.

You agree to these terms and conditions by purchasing a Studio LHK, LLC online interior design service package.
